Dear Mr. Murdoch:

 

Re:        Broadcasting Notice of Consultation CRTC 2009-411

              16 November 2009 Public Hearing

 

This is in response to your letter dated 16 November 2009 in which you request that the Commission reconsider its decision not to put on the public record of the proceeding initiated by Broadcasting Notice of Consultation CRTC 2009-411 (2009-411 Proceeding) certain data referenced in your letter to the Commission dated 10 November 2009.

As was stated in the Commission’s response to your letter of 10 November 2009, these data were requested as part of the proceeding initiated by Broadcasting Notice of Consultation CRTC 2009-614 (2009-614 Proceeding) and consequently will be placed on the public record of that proceeding on 30 November 2009.

While the Commission understands the concerns of CEP with respect to the relevance of this data to the 2009-411 Proceeding, it remains the position of the Commission that the data in question was requested by the Commission for the 2009-614 Proceeding and should form part of the public record of that proceeding and should not also be made part of the public record of the 2009-411 Proceeding.  

Further the Commission is also of the view, that to place this data on the public record of 2009-411 Proceeding at this time, i.e. after the commencement of this proceeding, would prejudice those parties that have already appeared and did not have the data available to them prior to their appearance.
