Dear Mr. Murdoch,

Re:        Notice of Consultation CRTC 2009-411

              16 November 2009 Public Hearing

This is in response to your letter dated 10 November 2009 in which you request that the Commission put on the public file of the 16 November 2009 public hearing the data that the Commission has requested from distribution undertakings in the context of the proceeding leading to the public hearing commencing on 7 December 2009.

This data was requested as part of the proceeding that was initiated by Notice of Consultation CRTC 2009-614 after the receipt by the Commission of Order in Council P.C. 2009-1569 by which the Governor in Council requested the Commission to hold hearings and make a report on the “implications and the advisability of implementing a compensation regime for the value of local television signals […] taking into account the comments of the general public on the impact of such a measure on consumers, and in particular, its impact on affordable access to a variety of local and regional news, information and public affairs programming [...] and how the application of such a regime would impact the various components of the communications industry [...]”. It is in this context that the Commission requested the data from distribution undertakings.

This data will be made available on 30 November 2009 and will be filed on the public record of that proceeding and not on the public record of the proceeding initiated by Notice of Consultation CRTC 2009-411. We note that CEP is participating in the December proceeding and thus will have the information available to it for the purpose of that participation.

Yours sincerely,

Original signed by
