Renewal of radio programming undertaking broadcasting licences due to expire 31 December 2009 – Licensees in apparent non-compliance

  The Commission announces that it has received broadcasting licence renewal applications for radio programming undertakings for which the licences are due to expire 31 December 2009.1 The licensees listed below have been found to be in apparent non-compliance with regulatory requirements during the current licence term. The following codes A to D identify the requirements with which the licensees are in apparent non-compliance:
  • A: failure to comply with the Radio Regulations, 1986 (the Regulations) relating to the broadcast of French-language vocal music;
  • B: failure to comply with the condition of licence relating to Canadian talent development (CTD) contributions;
  • C: failure to comply with the Regulations as they relate to devoting 35% or more of musical selections from content category 2 (Popular music) to Canadian selections broadcast in their entirety;
  • D: failure to comply with subsection 9(2) of the Regulations relating to the provision of annual reports.

The codes as they apply to the various licensees are also set out below.

  The Commission notes that, in addition to the conditions set out in the current licences, the renewed broadcasting licences will be subject, where applicable, to the conditions set out in New licence form for community radio stations, Public Notice CRTC 2000-157, 16 November 2000, and in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
  In Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006 (Broadcasting Public Notice 2006-158), the Commission set out a new approach to the development and promotion of Canadian artists. In order to reflect a new emphasis on development initiatives that lead to the creation of audio content for broadcast using Canadian resources, the Commission replaced the expression "Canadian talent development" (CTD) with "Canadian content development" (CCD). Each radio station holding a commercial radio licence is required to make a basic annual CCD contribution based on its revenues in the previous broadcast year. The basic contribution requirement has been enacted as a regulation, as set out in the Regulations, as amended from time to time.
  In the list below, stations identified with an asterisk (*) have been monitored by Commission staff. The monitoring report has been placed on each licensee's public examination file. A copy can be obtained by contacting one of the Commission's documentation centres.
  The Commission notes that other such licences expiring in 2009 will be dealt with at a later date.

  The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.
  Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

  A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.
  Submissions longer than five pages should include a summary.
  Each paragraph of the submission should be numbered.
