Cogeco Cable Inc. – Third-party Internet access service

The Commission received an application by Cogeco Cable Inc. (Cogeco), dated 4 September 2009,1 in which the company proposed changes to its wholesale third-party Internet access (TPIA) service. The company submitted that these changes would correspond to changes it had made to its retail Internet services. In addition, Cogeco proposed housekeeping changes to its TPIA tariff in order to modify certain cross-references. The Commission granted interim approval to Cogeco's application in Telecom Order CRTC 2009-603, 30 September 2009.

The Commission received comments on Cogeco's application from TekSavvy Solutions Inc. (TSI). The public record of this proceeding is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings" or by using the file number provided above.

In its comments, TSI objected to some of Cogeco's proposed housekeeping changes. TSI submitted that some of the proposed changes resulted in ambiguity, while others appeared to be inaccurate. TSI also submitted that Cogeco's TPIA tariff did not include a statement that excess usage charges applicable to TPIA services would be equivalent to the excess usage charges applicable to its retail Internet services.

The Commission received a modified application by Cogeco, dated 8 October 2009, in which the company addressed TSI's objections.

The Commission considers that Cogeco's proposed modifications provide a satisfactory response to TSI's comments. Accordingly, the Commission approves on an interim basis Cogeco's modified application, effective the date of this order.
