  Application by Canwest Television GP Inc. (the general partner) and Canwest Media Inc. (the limited partner), carrying business as Canwest Television Limited Partnership (Canwest) to amend the above noted broadcasting licences of television programming undertakings in order to increase their flexibility in fulfilling their described video programming commitments.
  In Accessibility of telecommunications and broadcasting services, Broadcasting and Telecom Regulatory Policy CRTC 2009-430, 21 July 2009, the Commission invited conventional broadcasters to apply to amend their licences in order to provide these broadcasters with a measure of flexibility and to take into account requests from persons with disabilities for a wider choice of described programming. The Commission considered it appropriate to add two more categories of programming to those that licensees of conventional television stations may use to fulfil their commitments for described video: 9 (Variety) and 11 (General entertainment and human interest).
  Accordingly, Canwest requests the addition of programming categories 9 (Variety) and 11 (General Entertainment and Human Interest) to the list of categories from which it can draw programming in order to meet its described video requirements.
  The licensee proposes to replace the condition of licence relating to described video which reads:
 

4. a) The licensee shall broadcast in years 3 and 4 of the licence term an average of 3 hours per week of described Canadian priority programs from categories 7 (Drama) and 2b (Long-form documentary), between 7 p.m. and 11 p.m.

 

b) The licensee shall broadcast in year 5, and for the remainder of the licence term, an average of 4 hours per week of described Canadian priority programs from categories 7 (Drama) and 2b (Long-form documentary), between 7 p.m. and 11 p.m.

  In fulfilling this condition, a minimum of 50% of the required hours must be original broadcasts. Further, the licensee may broadcast up to one hour per week of described children's programming at an appropriate children's viewing time.
  With the following:
 

4. a) The licensee shall broadcast in years 3 and 4 of the licence term an average of 3 hours per week of described Canadian priority programs from categories 7 (Drama) and 2(b) (Long-form documentary), between 7 p.m. and 11 p.m.

 

b) The licensee shall broadcast in year 5, and for the remainder of the licence term, an average of 4 hours per week of described Canadian priority programs from categories 7 (Drama) and 2(b) (Long-form documentary), between 7 p.m. and 11 p.m.

 

c) As of 21 July 2009, the conditions of licence imposed on conventional television stations will allow them to fulfil their commitments for described video with programming from the following categories: 2(b) Long-form documentary; 7(a) Ongoing Dramatic Series; 7(b) Ongoing comedy series (sitcoms); 7(c) Specials, mini-series or made-for-TV feature films; 7(d) Theatrical feature films aired on TV; 7(e) Animated television programs and films; 7(g) Other drama; 9 Variety; and 11 General entertainment and human interest, as well as programming targeted to children.

  In fulfilling this condition, a minimum of 50% of the required hours must be original broadcasts. Further, the licensee may broadcast up to one hour per week of described children’s programming at an appropriate children’s viewing time.

  Application by Rogers Broadcasting Limited to amend the broadcasting licence of the English-language commercial FM radio programming undertaking CIOC-FM Victoria, British Columbia.
  The licensee proposes to add an FM transmitter at Saltspring Island, British Columbia to broadcast the programming of CIOC-FM Victoria, British Columbia in order to improve reception quality within the existing coverage area of CIOC-FM.
  The transmitter would operate on frequency 98.5 MHz (channel 253C1) with an average effective radiated power (ERP) of 635 watts (maximum ERP of 3,500 watts with an effective height of antenna above average terrain of 662 metres).
  This would be a synchronous repeater, using the same frequency as CIOC-FM.
  The licensee states that a transmitter located on Saltspring Island would be the optimal solution to correcting the reception deficiencies of CIOC-FM to the north of its coverage area.

  A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Parties must ensure, before initiating service through electronic mode, that they will be able to satisfy the Commission, upon request, that service of the notification was completed.
