  The licensee proposes to change the authorized contours by increasing the average effective radiated power from 65,800 to 100,000 watts, by replacing its directional antenna with an omni-directional antenna (maximum effective radiated power 100,000 watts) and by decreasing the effective height of the antenna above average terrain from 217 to 215 metres.
  The licensee stated that this change will reduce the protected area that currently exists between CKNX-FM and CIBU-FM, both owned and operated by the licensee, and CIWV-FM, owned and operated by Durham Radio Inc. All parties agree to eliminate their protection to allow for maximum use of their channels.

  The licensee stated that this change will reduce the protected area that currently exists between CIWV-FM, owned and operated by the licensee, and CIBU-FM and CKNX-FM, both owned and operated by Blackburn Radio Inc. All parties agree to eliminate their protection to allow for maximum use of their channels.

  Application by Newcap Inc. (Newcap) relating to the broadcasting licence for the English-language commercial FM radio programming undertaking CFUL-FM Calgary.
  The licensee proposes to amend the technical parameters of CFUL-FM by modifying the antenna radiation pattern from directional to non-directional, by increasing the average effective radiated power from 48,000 watts to an effective radiated power of 100,000 watts, by increasing the effective height of the antenna above average terrain from 160 to 342.2 metres and by relocating the antenna to another site.
  The licensee stated that these changes will allow it to improve its service and will permit it to optimize the use of the frequency.
  Newcap indicated that the changes proposed in this application will allow it to reduce its operating costs and provide improved operating and maintenance efficiencies for this transmitter and its CFXL-FM Calgary transmitter. Consequently, Newcap requests that this application be processed simultaneously with a similar application for its station CFXL-FM (application 2009-0517-7, item 5 of this Notice of Consultation).

  The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.
  Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

  A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Parties must ensure, before initiating service through electronic mode, that they will be able to satisfy the Commission, upon request, that service of the notification was completed.
  Where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
  Each paragraph of the document should be numbered.
  Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
