  Application by Rogers Cable Communications Inc. (Rogers) to amend the regional licences of all of its cable broadcasting distribution undertakings serving various locations in New Brunswick, Newfoundland and Labrador and Ontario.
  Rogers proposes to amend its current condition of licence authorizing the distribution, on a digital discretionary basis, of any of the distant Canadian television signals set out in the List of Part 3 eligible satellite services and a second set of signals that provides the programming of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial PBS network (hereafter referred to as the U.S. 4+1 signals) so that it reads as follows:
  The licensee is authorized to distribute the following signals on a digital discretionary basis:
 

any of the distant Canadian television signals set out in the List of Part 3 eligible satellite services*; and

 

a second set of signals that provides the programming of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial PBS network (hereafter referred to as the U.S. 4+1 signals).

  The distribution on a discretionary basis on the licensee's digital service of a second set of U.S. 4+1 signals and distant Canadian signals is subject to the provision that, with respect to such signals, the licensee adhere to the requirements regarding non-simultaneous program deletion set out in section 43 of the Broadcasting Distribution Regulations. The Commission may suspend the application of this provision, with respect to the signals to be distributed, upon its approval of an executed agreement between the licensee and broadcasters. Such an agreement must deal with issues related to the protection of program rights arising in connection with the discretionary carriage of a second set of U.S. 4+1 signals and distant Canadian signals solely on the licensee's digital service.
  Rogers also requests the suspension of the application of section 43 of the Broadcasting Distribution Regulations relating to the requirements regarding non-simultaneous program deletion since it has now negotiated an Agreement with the Canadian Association of Broadcasters pertaining to the protection of program rights arising in connection with the carriage of a second set of U.S. 4+1 signals and distant Canadian signals on a digital discretionary basis.

  Application by Sun TV Company to amend the licence of the English-language transitional digital television programming undertaking CKXT-DT Toronto, Ontario.
  The licensee proposes to amend the licence by changing the channel of its transmitter at Ottawa, Ontario from 62C to 20C.
  The licensee also proposes to change the authorized contours of its transmitter at Ottawa by increasing the average effective radiated power from 4,600 watts to 5,100 watts (maximum effective radiated power 9,300 watts/effective antenna height of 332.9 metres).
  The licensee advises that the proposed changes are the result of it sharing TV Ontario's antenna instead of installing a separate new antenna system.

  Application by Encore Avenue Ltd. to amend the licence of the regional pay programming undertaking known as Encore Avenue.
  The licensee proposes to amend the condition of licence relating to program categories with the following:

theatrical feature films aired on television (subcategory 7d) copyrighted at least three years prior to the year in which they are distributed by the service.

  The licensee indicates that given the competitive environment in which it operates, it needs more flexibility with respect to particular programming categories it can broadcast and that it also needs a modification to its obligation to broadcast only movies with five years old copyrights to broaden the scope of the movies it can broadcast.
