Applications processed pursuant to streamlined procedures

  In this public notice, the Commission sets out lists of applications that did not require a public process and that it processed during the period 1 July 2008 to 31 August 2008 pursuant to its streamlined procedures. These applications involve transfers of ownership and changes in the effective control of broadcasting undertakings, as well as applications for amendments or extensions of deadlines.

The Commission has streamlined procedures for its consideration of applications that involve transfers of ownership and changes in the effective control of broadcasting undertakings, amendments or extensions of deadlines, and that do not require a public process.1 Under these procedures, and on a case-by-case basis, the Commission may approve or deny such an application without first having issued a public notice provided that:
 

a) its examination of the application reveals no significant policy concern; and

 

b) the Commission is convinced that approval or denial would be consistent with its approvals or denials of previous applications.

Where these two conditions are met, the Commission is generally satisfied that a process initiated by a public notice is not required in the public interest and would unnecessarily delay implementation of the transaction contemplated or of other proposals by the applicant.

In the appendices to this public notice, the Commission sets out lists of applications that did not require a public process and that it processed during the period 1 July 2008 to 31 August 2008 pursuant to its streamlined procedures. The list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings is set out in Appendix 1. The list of applications involving amendments or extensions of deadlines is set out in Appendix 2.

Hill, through the transfer of 89% of the voting interest of the parent corporation of Walsh Investments Inc. and Yorkton Broadcasting Company Limited to Harvard Broadcasting Inc., a corporation controlled by Frederick W. Hill.

GX Radio is the licensee of CJGX Yorkton, and CFGW-FM Yorkton Saskatchewan and its transmitters CFGW-FM-1 Swan River, Manitoba and CFGW-FM-2 Wapella, Saskatchewan.
 

2. Lighthouse Broadcasting Ltd.

APPROVED - Change in the effective control of Lighthouse Broadcasting Ltd. (Lighthouse) from Scott Raible to Patrick Lough, through the transfer of all of the issued shares of Lighthouse to Strive Communications Inc., a corporation controlled by Patrick Lough.

Lighthouse is the licensee of the low power Christian music FM radio station CJLT-FM Medicine Hat, Alberta.
 

3. Rogers Communications Inc.

APPROVED - Intra-corporate reorganization, for estate purposes, at the level of Rogers Communications Inc. (RCI) involving the insertion of a new corporate entity in RCI ownership chain.

RCI owns through subsidiaries various radio, television, specialty services, pay-per-view and video-on-demand services and broadcasting distribution undertakings across Canada.
 

4. 1760791 Ontario Inc.

APPROVED - Change in the ownership structure of 1760791 Ontario Inc. (1760791), through the transfer of all of the issued shares of 1760791 from Neeti P. Ray (67%) and Renu Ray (33%) to The Neeti P. Ray Family Trust. Effective control continues to be exercised by Mr. Neeti P. Ray.

1760791 is authorized to operate CINA Mississauga, Ontario and is the parent corporation of a corporation to be incorporated and authorized to operate CJNR-FM Windsor, Ontario. Licences have not been issued as both stations are not yet in operation.
 

5. Glassbox Television Inc. 2008-0723-2

APPROVED - Change in the effective control of Glassbox Television Inc. (Glassbox) from a legal control exercised by Jeffrey Elliott to a control exercised by the board of directors of Glassbox.

Glassbox is the licensee of BiteTv, a Category 2 speciatly television service.
 

6. TQS inc. 2008-1135-8

APPROVED - Change in the ownership structure of TQS Inc. approved in Broadcasting Decision CRTC 2008-129, 26 June 2008. The present change in the ownership structure is accomplished through a multi-step reorganization and affects the ownership of 394724 Canada Inc., TQS's parent corporation. Effective control is not affected and will continue to be exercised by Julien and Maxime Rémillard.
