NorthernTel, Limited Partnership

  Reference: Tariff Notice 243

Administrative revisions

The Commission received an application by NorthernTel, Limited Partnership (NorthernTel), dated 29 October 2007, in which the company proposed to revise the following sections of its General Tariff: section N200, subsection 6, High Speed Access Service; section N900, subsection 6, Asymmetric Digital Subscriber Line (ADSL) Access Service; and section N900, subsection 19, Gateway Access Service.

Specifically, NorthernTel proposed administrative revisions to reflect the implementation of local competition pursuant to Telecom Decision 2007-93, such as references to competitive local exchange carriers. NorthernTel also proposed minor wording revisions.

In Telecom Order 2007-420, the Commission approved on an interim basis NorthernTel's application.

The Commission received comments regarding NorthernTel's application from Ontera. The record of this proceeding closed with NorthernTel's reply comments, dated 14 December 2007. The public record of this proceeding is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings."

Ontera noted that section N900, subsection 6, paragraph 6.01 c) of NorthernTel's General Tariff referred to co-location subject to a special assembly tariff. Ontera submitted that co-location services were already described and priced in section N200. Ontera requested clarification as to whether NorthernTel was proposing to offer a co-location arrangement that differed from that described in section N200.

In reply, NorthernTel indicated that it would remove from paragraph 6.01 c) the reference to co-location requests being handled through a special assembly tariff, as this was an oversight.

The Commission notes that, in a subsequent application, NorthernTel proposed to remove the reference to co-location requests. In Telecom Order 2008-7, the Commission approved on an interim basis NorthernTel's application to remove that reference. The Commission considers that NorthernTel has clarified its General Tariff with respect to Ontera's comments.

In light of the above, the Commission approves on a final basis NorthernTel's application.
