Re:   Tariff Notice 501 - Basic and Regional Service

On 16 December 2008, the Commission received an application from TELUS Communications Company (TCC), under cover of tariff notice 501 (TN 501), in which the company proposed modifications to item 2.01.06 b., Business Centrex Services, as well as to item 2.16.04, Promotion -Restriction on Long Distance.

Commission staff notes that TCC filed TN 501 indicating that it complied with the definition of Group A retail services, as defined in Approval mechanisms for retail and CLEC tariffs, Telecom Decision CRTC 2008-74 (Decision 2008-74). However, since TN 501 proposed, among other things, a modification to the terms and conditions of a tariff, Commission staff advises TCC that its application will be considered pursuant to the process established in Decision 2008-74 for applications that comply with the definition of Group B retail services. Accordingly, the modifications proposed in TN 501 should not have come into effect on 16 December 2008, as proposed by TCC.

Yours sincerely,
