RE: Tariff Notice 23 - Competitive Local Exchange Carrier General Tariff

On 1 st December 2008, the Commission received an application by EastLink, under cover of Tariff Notice 23, in which the company proposed revisions to its Competitive Local Exchange Carrier (CLEC) General Tariff.

Commission staff notes that, in its application, EastLink proposed to continue to use its own rates for certain interconnection services rather than those currently approved for the ILECs. In light of the regulatory regime that applies to CLEC pursuant to Local Competition, Telecom Decision CRTC 97-8, 1 st May 1997, Commission staff is examining whether it would be appropriate to grant final approval to EastLink's interconnection rates.

Consequently, this application will not be approved on a final basis 7 calendar days after the comment period has passed . The Commission intends to dispose of this application prior to the end of January 2009.

Yours sincerely,
