Re: Application by Kincardine for local competition in Bruce Telecom and HuronTel territories

Pursuant to Commission staff's 7 November 2008 letter asking Kincardine Cable TV Ltd (Kincardine) to confirm its intention to become a CLEC in the territories of Bruce Telecom (Bruce) and Huron Telecommunications Co-operative Limited (HuronTel), the Commission received a letter from Kincardine dated 17 November 2008 where it stated that it had "provided all of the information to fulfill the Proposed CLEC requirements".

Commission staff notes that in an email to Kincardine dated 23 July 2008, it was indicated to Kincardine that in order to complete its application to obtain proposed CLEC status, it must:

Commission staff notes that Kincardine has yet to register electronically with the DCS and to complete the required forms.

In their reply letters dated 25 November 2008, Bruce and HuronTel both stated that they would not consider Kincardine's applications to be bona fide until it obtained proposed CLEC status.

In light of the records of these proceedings, Commission staff expects Kincardine to take the steps necessary to obtain proposed CLEC status, as outlined above, as soon as possible.

Commission staff will issue a new process letter, including the filing dates of the implementation plans, if required, once Kincardine obtains proposed CLEC status.
