RE:   Public Works and Government Services Canada Application for a Commission Decision pursuant to Section 27 of the Telecommunications Act regarding telecommunications services provided by Bell Canada

 

On 20 November 2008, Commission staff issued a letter in respect of Public Works and Government Services Canada's (PWGSC) application of 10 November 2008 for a Commission determination in relation to the continued delivery of certain services currently provided by Bell Canada pursuant to a customer specific arrangement that expires on 15 December 2008.

 

In its letter, Commission staff stated that it expected PWGSC and Bell Canada to continue negotiations to resolve the matter without Commission intervention. In the absence of a negotiated agreement between the two parties by 28 November 2008, Commission staff indicated that it would establish an expedited process to determine terms upon which the services would be provided after 15 December 2008.

 

On 28 November 2008, the Commission received comments from PWGSC and Bell Canada in a joint submission.   PWGSC and Bell Canada submitted that the parties have been unable to reach an agreement concerning the delivery of the services by Bell Canada . In their submission, the parties also questioned whether the Commission can impose final offer arbitration, or any other means of binding dispute resolution, in the context of PWGSC's application.

 

Commission staff notes that in its application, PWGSC requested, among other things, that the Commission determine pricing that would be just and reasonable in the event the Commission determined that Bell's pricing proposal does not comply with subsections 27(1) and 27(2) of the Telecommunications Act .

 

Commission staff notes that PWGSC appeared to request a binding determination in its application. In order to clarify its position, PWGSC is to file with the Commission by 2 December 2008 (end of day), copying those on the attached distribution list, a statement clearly setting out the relief it seeks, including Commission orders or directions, if any.
