Re: Cybersurf Application pursuant to Part VII of the CRTC Telecommunications Rules of Procedure for relief against Bell Canada regarding certain billing practices and disconnection - Process for interim relief.
Dear Ms. Song and Mr. Abbott:
Commission staff is in receipt of an application, dated 26 November 2008, made by Cybersurf Corp. (Cybersurf) pursuant to Articles 7, 17.3 and 22.2 of Bell Canada's Terms of Services, sections 32(g), 48, 51, 55, 57, 60 and 61(2) of the Telecommunications Act and Part VII of the CRTC Telecommunications Rules of Procedure requesting that the Commission make a number of orders with respect to Bell Canada's billing practices and the alleged arrears incurred by Cybersurf as a result of those billing practices.
As part of its application, Cybersurf made a request for interim relief on an expedited basis. Specifically, Cybersurf requested that the Commission suspend Bell Canada 's disconnection notice dated 29 October 2008 until such time as the Commission renders its final determination on the application.
Commission staff notes that Bell Canada has since agreed not to disconnect Cybersurf's services pursuant to the 29 October 2008 disconnection notice until after the Commission has made a determination on interim relief. Thereafter, Bell Canada will only disconnect Cybersurf's services pursuant to the 29 October 2008 disconnection notice if such action does not conflict with the Commission's interim determination.
The parties are to file submissions in accordance with the process set out below.

The process for disposition of Cybersurf's application for final orders will be set out no later than the date of the Commission's decision on Cybersruf's request for interim relief.
