RE:   Public Works and Government Services Canada Application for a Commission Decision pursuant to Section 27 of the Telecommunications Act regarding telecommunications services provided by Bell Canada

On 14 November 2008, the Commission issued a letter with respect to Public Works and Government Services Canada's (PWGSC's) request for an expedited process as part of its application filed pursuant to Part VII of the CRTC Telecommunications Rules of Procedure (the Rules). The Commission sought comments as to whether an expedited process was necessary.  

Comments were received from PWGSC, Bell Canada, Telus Communications Company (TCC), and MTS Allstream Inc. (MTS Allstream) on 18 November 2008. All parties agreed that given the time constraints and urgency of the matter, an expedited process would be appropriate.  

In their submissions, PWGSC and Bell Canada indicated that they were continuing to negotiate the terms upon which the services would be provided after 15 December 2008 . Commission staff expects the parties to continue negotiations to resolve the matter without Commission intervention. However, if an agreement is not reached by 28 November 2008 , PWGSC and Bell Canada are to jointly provide the Commission on that date with a summary of the issues in dispute. The joint submission should also identify:   1) all the services that are being requested by PWGSC, specifically indicating which services are tariffed and which are not, and 2) the length of time the specific services will be required. A copy of this submission should also be sent to the following email addresses:   christine.bailey@crtc.gc.ca and anthony.mcintyre@crtc.gc.ca .

In the absence of a negotiated agreement between the two parties, on 1 st  December 2008 the Commission will establish an expedited process to determine terms upon which the service would be provided after 15 December 2008. As an option for such a process, the Commission will consider final offer arbitration, which would require the submission of binding offers from the parties.
