Re: TBayTel - Shaw Partial Systems Agreement

In its letter dated 4 June 2008, Commission staff set out a process to establish the terms and conditions of a Partial System Agreement ( PSA ) between TBayTel and Shaw.   Both companies then provided the Commission and each other revised versions of a draft PSA.

Staff notes that to date all versions of the draft PSA have been filed with the Commission in confidence.   However, neither company has, as required by the CRTC Telecommunications Rules of Procedure, made any claim for confidentiality or submitted any justification for such a claim.

Staff notes that it is the usual practice to file all agreements associated with tariffs on the public record.   Staff requests each company to re-file all documents submitted in confidence to date on the public record by 31 October 2008.

If either company wishes to claim confidentiality for any of the material filed to date, it must file on the public record detailed and specific reasons to support such a claim, along with an abridged version of the material, redacting as little as possible, or detailed and specific reasons for objecting to filing an abridged version.

Any such claim and material is to be received by the Commission by 31 October 2008, with a copy to the other party.
