Re:   Modification to procedure for Telecom Public Notice CRTC 2008-9, Call for comments on TELUS Communications Company's proposed relief from requirements for the expansion of local calling area regulatory framework

The Commission received an application by TELUS Communications Company (TCC), dated 19 March 2008, requesting that the Commission make a determination that the expanded local calling area (LCA) regulatory framework established in Framework for the expansion of local calling areas , Telecom Decision CRTC 2002-56, 12 September 2002, (LCA regulatory framework) should not apply in communities of interest (COI) that include at least one local exchange where the Commission has forborne from regulating local exchange services.

In Call for comments on TELUS Communications Company's proposed relief from requirements for the expansion of local calling area regulatory framework , Telecom Public Notice 2008-9, 11 June 2008 (Public Notice 2008-9), the Commission invited parties to comment on:

(1) the continued appropriateness, in light of the order issuing a Direction to the CRTC on Implementing Canadian Telecommunications Policy objectives, P.C. 1534, 14 December 2006, of the expanded LCA regulatory framework;

(2) whether and how the expanded LCA regulatory framework, if it is appropriate to retain it, should be modified to take into consideration the fact that local residential and business services have been forborne in many exchanges; and

(3) including TCC's proposal that the expanded LCA regulatory framework should not apply in COIs that include at least one local exchange that has been forborne from regulation of local exchange services.

The Commission received submissions from Bell Aliant Regional Communications, Limited Partnership, Bell Canada, and Telebec, Limited Partnership [collectively, Bell Canada et al.]; MTS Allstream Inc.; Primus Telecommunications Canada Inc.; and TCC, but none from municipalities.

Commission staff notes that the record of this proceeding [1] indicates that there are a significant number of pending requests from local governments for expanded LCAs with the incumbent local exchange carriers, as well as letters from other local governments expressing interest in establishing expanded LCAs.

As the decision to be issued in this proceeding could have an impact on municipalities with respect to expanded LCAs, Commission staff considers that it would be appropriate to amend Public Notice 2008-9 to invite municipalities to comment.

In light of the above, Commission staff considers it appropriate that the following be added to the procedure identified in Public Notice 2008-9:

a)   municipalities are invited to file with the Commission, serving copies on all parties, comments regarding the issues in this proceeding by date of letter +30 days;

b)   if any such comments are received, all other parties may file with the Commission reply comments to submissions filed by municipalities, pursuant to a), serving copies on all parties by date of letter +45 days.

Commission staff notes that where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
