Re: Application by Kincardine for local competition in Bruce Telecom's territory

In paragraph 160 of Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision CRTC 2006-14, 29 March 2006 (Decision 2006-14), the Commission directed each small incumbent local exchange carrier (SILEC) to file an implementation plan with the Commission within 30 days of a formal signed expression of interest from a local exchange carrier or carrier to use competitor services within a SILEC's territory. The Commission indicated that this plan should include certain details, such as when tariffs will be filed, the nature and cost basis of those tariffs, how customer transfer procedures would be managed, the timing of the implementation of local competitor services, the start-up costs to implement local competition including local number portability if appropriate and how those costs will be recovered, and any other implementation issues that may be unique to that SILEC.

On 11 October 2007, pursuant to paragraph 160 of Decision 2006-14, Kincardine Cable TV Ltd. (Kincardine) sent a letter to Bruce Telecom. In its letter, Kincardine presented Bruce Telecom with a formal expression of Kincardine's interest in using competitor services in the incumbent territory of Bruce Telecom . However, the Commission has not yet received an implementation plan from Bruce Telecom concerning Kincardine's application. In a letter to the Commission dated 26 June 2008 , Kincardine also noted that it had received little feedback from Bruce Telecom.

Commission staff considers that Bruce Telecom's implementation plan falls within the scope of Part VII of the CRTC Telecommunications Rules of Procedure. Commission staff therefore considers the applicable procedure to be as follows:

i)    Bruce Telecom has until 13 November 2008 to submit its implementation plan and to send a copy to Kincardine;

ii)   Interested parties have until 27 November 2008 to submit comments on Bruce Telecom's implementation plan and to send a copy to Bruce Telecom;

iii)   Bruce Telecom has until 8 December 2008 to submit its reply comments.

Where a document is to be filed by a specific date, the document must be actually received, and not merely sent, by that date.
