RE: Part VII Application by Tuckersmith Communications Co‑operative Ltd. against Bluewater TV Cable Ltd.

The Commission received an application by Tuckersmith Communications Co‑operative Ltd. (Tuckersmith) dated 5 September 2008, under the Part VII of the CRTC Telecommunications Rules of Procedure.  In its application, Tuckersmith requested that the Commission issue certain orders directing Bluewater TC Cable Ltd. (Bluewater):

  • to cease and desist from the unauthorized and inappropriate delivery of competitive local exchange services to subscribers situated within the incumbent local exchange areas of Tuckersmith, and

  • to advise in writing any subscriber currently being provided such service that the service will be terminated in 30 days of the issuance of such orders

Commission staff notes that Tuckersmith requested that the Commission dispose of its application on an expedited basis.  Commission staff considers that, in this case, a shorter answer and reply process than prescribed in the CRTC Telecommunications Rules of Procedure should take place.  Accordingly, Bluewater has until 17 September 2008, to file an answer and serve a copy on Tuckersmith, and Tuckersmith has until 19 September 2008, to file a reply and serve a copy of the reply on Bluewater.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
