LetterOttawa, 11 August 2008 File No.: 8640-B54-200809767 By email Jim Stinson Dear Mr. Stinson : Re: Part VII application for forbearance from the regulation business local exchange services in the exchanges of Goderich and Lucknow, Ontario Part VII application for forbearance from the regulation business local exchange services in the exchange of Clinton, Ontario On 15 July 2008, the Commission received the above-mentioned Part VII applications by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant) pursuant to Telecom Decision 2006-15 as amended by the Governor in Council's Order Varying Telecom Decision CRTC 2006-15, P.C. 2007-532, 4 April 2007 (Telecom Decision 2006-15). Pursuant to Telecom Circular 2007-13, 19 April 2007, comments from participating parties must be filed within 20 calendar days of the date of the application. In order to complete the record in the above-mentioned applications, Bluewater TV Cable Limited is to provide by 15 August 2008 comments on its capability to serve at least 75 percent of the number of business local exchange service lines that Bell Aliant is capable of serving in the exchanges of Clinton, Goderich and Lucknow. Commission staff also notes that paragraph 523 of Telecom Decision 2006-15 provides an opportunity for certain small competitors to gain a foothold in a market prior to economic deregulation: If, prior to granting local forbearance, the Commission is informed that the ILEC's application is based on competition in the relevant market from an independent fixed-line telecommunications service provider that, including all of its affiliates, has less than 20,000 local exchange services customers in Canada, the forbearance will not be effective until at least 18 months after the day on which the service provider began providing local exchange services in that market. Please confirm whether the above paragraph is applicable to your company by providing the Commission with details. Where a document is to be filed by a specific date, the document must be received, and not merely sent, by that date. Yours sincerely, Original signed by Mario Bertrand c.c.: Denis E. Henry, Bell Aliant Regional Communications, Limited Partnership |
