Re: TELUS Communications Company - Application to review and vary Telecom Decision CRTC 2008-1
On 23 April 2008, TELUS Communications Company (TCC) filed an application pursuant to section 62 of the Telecommunications Act , requesting that the Commission review and vary its determinations in Use of deferral account funds to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities , Telecom Decision CRTC 2008-1, 17 January 2008 (Decision 2008-1). TCC seeks to rescind paragraphs 113 and 114 of Decision 2008-1, thereby permitting it to use the remaining deferral account funds for broadband expansion. Commission staff notes that comments have been received in relation to this application, and that the intervenor comment period for the proceeding ended on 23 May 2008 .
Commission staff notes that in Service standards for the disposition of telecommunications applications , Telecom Circular CRTC 2006-11, 7 December 2006, the Commission stated that it would categorize Part VII applications into two types: Type 1 applications that generally do not involve multiple parties or raise significant policy issues, and Type 2 applications that do involve multiple parties and/or raise significant policy issues.
Commission staff also notes that the Commission has adopted the following service standards for Part VII applications:
• Type 1 Part VII applications - 90 percent of determinations to be issued on an interim or final basis within four months of the close-of-record; and
• Type 2 Part VII applications - 85 percent of determinations to be issued on an interim or final basis within eight months of the close-of-record.
Commission staff has assessed the application of TCC and considers it to be a Type 2 application. Accordingly, the Commission expects to issue an interim or final determination within 8 months of the close-of-record.
