Re: People's Tel Limited Partenership implementation plan for local competition in Forest and Arkona exchanges in Ontario

On 10 March 2008, the Commission received People's Tel Limited Partnership (People's Tel) implementation plan for local competition with Execulink Telecom Inc. (Execulink) in the Forest and Arkona exchanges in People's Tels territory, but which did not include a cost recovery proposal.  People's Tel proposed an implementation date of 1 December 2008, as it would only be able to deploy a DMS-100 switch in the fall of 2008.

The Commission received comments from Execulink on 22 March and 31 March 2008.  Execulink proposed a "work-around" to the issue of switch deployment, which, it argued, could allow People's Tel to implement local competition by 1 August 2008, prior to People's Tel's planned replacement of its existing DMS-10 by a DMS-100.

Process for dealing with People's Tel's implementation plan:

To move the process forward, Commission staff sets out the following process for dealing with the implementation of local competition in People's Tel's serving territory in the Forest and Arkona exchanges in Ontario.

  1. People's Tel is requested to provide its views, with rationale, by 9 June 2008, as to whether or not Execulink's "work-around" proposal to implement local competition is feasible; if not, provide the technical and/or economic reasons why the Execulink's proposal is not feasible.  If yes, provide estimate as to how long it would take and how much it would cost to implement Execulink's "work-around proposal.

  2. People's Tel is requested to file, by 26 June 2008, a proposal to recover the causal costs associated with the implementation of local competition in its serving territory in the Forest and Arkona exchanges in Ontario (the cost recovery proposal).  The cost recovery proposal should include the causal costs to implement local competition, including the costs of implementing Local Number Portability if requested by Execulink, and how the company proposes to recover these costs;

    a.  Interested parties will have until 10 July 2008 to provide comments on People's Tel local competition implementation plan including its cost recovery proposal,

b.  People's Tel will have until 24 July 2008 to provide reply comments.

Bell Aliant's request for co-location:

Staff notes that on 23 April 2008, the Commission received comments from Bell Aliant Regional Communications, Limited Partnership (Bell Aliant).  Bell Aliant submitted that by letter dated 14 August 2007, it had indicated to People's Tel its intention to co-locate in the Forest central office for the purpose of toll interconnection and it also requested People's Tel to file co-location tariffs for the Commission's approval.  Bell Aliant indicated that to date, it has not received any response from People's Tel as to its requests.

In its reply comments, People's Tel submitted that it would deal separately with Bell Aliant's request for co-location.

Pursuant to Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision 2006-14, 29 March 2006, People's Tel should make co‑location space available to Bell Aliant, where space is available, under similar terms and conditions established for co-location services for the large Incumbent Local Exchange Carriers.  To that end, People's Tel is requested to file co-location tariffs by 16 June 2008.  People's Tel is requested to advise the Commission and Bell Aliant by 2 June 2008 if it has issues or concerns regarding the filing of co‑location tariffs.
