RE: Saskatchewan Telecommunications Tariff Notice 37- Network planning information regarding the location of switching facilities

On 25 November 2002, the Commission received an application by Saskatchewan Telecommunications (SaskTel), under cover of Tariff Notice 37, in which the company proposed revisions to its Competitor Access Tariff, Item 610.28, Network Planning Information Regarding the Location of Switching Facilities.   SaskTel also proposed that tariff item 610.28 be classified as a Category II Competitor Service.

Commission staff notes that this application received interim approval in Telecom Order CRTC 2003-59, 31 January 2003.   In that order, the Commission stated that classification of this service would be addressed in the follow-up to Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002.   However, Commission staff notes that classification of this service was not addressed by the incumbent local exchange carriers and competitors in the follow-up proceeding, nor were they addressed by the Commission in Follow-up to Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34 - Service basket assignment , Telecom Decision CRTC 2003-11, 18 March 2003.  

Commission staff notes that this service was classified in Regulatory policy - Revised regulatory framework for wholesale services and definition of essential service , Telecom Decision CRTC 2008-17, 3 March 2008, as conditional essential, with rates to be based on Phase II costs plus a 15 percent mark-up.

In light of this, the Commission requests that SaskTel provide rationale as to why item 610.28, Network Planning Information Regarding the Location of Switching Facilities, should not be priced at Phase II costs plus a 15 percent mark-up.   SaskTel is to file its response within 10 calendar days of receipt of this letter.
