Tariff Notice 58 - Network planning information On 27 November 2002, the Commission received an application by Aliant Telecom Inc., now Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), under cover of Tariff Notice 58, in which the company proposed revisions to General Tariff Item 100 - Definitions, and proposed to add item 604.2 Network Planning Information to its General Tariff. Bell Aliant also proposed that tariff item 604.2 be classified as a Category II Competitor Service. Commission staff notes that this application received interim approval in Telecom Order CRTC 2003-57, 31 January 2003 . In that order, the Commission stated that classification of this service would be addressed in the follow-up to Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002 . However, Commission staff notes that classification of this service was not addressed by the incumbent local exchange carriers and competitors in the follow-up proceeding, nor were they addressed by the Commission in Follow-up to Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34 - Service basket assignment , Telecom Decision CRTC 2003-11, 18 March 2003. Commission staff notes that this service was classified in Regulatory policy - Revised regulatory framework for wholesale services and definition of essential service , Telecom Decision CRTC 2008-17, 3 March 2008, as conditional In light of this, the Commission requests that Bell Aliant provide rationale as to why item 604.2, Network Planning Information, should not be priced at Phase II costs plus a 15 percent mark-up.
