RE: TBayTel / Shaw Telecom Inc. - Agreement for LEC-IXC Interconnection

On 24 April 2008, the Commission received an application by TBayTel in which the company requested the Commission's approval of the Master Agreement for Interconnection between local exchange carriers (LECs) and interexchange carriers (IXCs) (LEC-IXC agreement) it entered into with Shaw Telecom Inc.

Commission staff notes that in Forbearance with respect to certain inter-carrier agreements filed pursuant to section 29 of the Telecommunications Act, Telecom Decision CRTC 2007-129, 14 December 2007 (Decision 2007-129), the Commission determined that LEC-IXC agreements which were identical to Commission-approved models no longer had to be filed for Commission approval. Commission staff notes that the agreement filed by TBayTel is identical to the Commission-approved model LEC-IXC agreement.

Consequently, this application is closed.

However, consistent with Decision 2007-129, existing LECs must provide the Commission with the name of the parties and the date of execution of any Commission-approved standard form LEC-IXC agreement on a quarterly basis within fourteen days of the close of the quarter in question.
