Re:   Part VII Application by Bragg Communications Inc., Cogeco Cable Canada Inc., Quebecor Media Inc. on behalf of its affiliate Videotron Ltd., Rogers Cable Communications Inc. and Shaw Communications Inc. to review and vary Telecom Decision CRTC 2007-130

The Commission is in receipt of comments from the Canadian Independent Telephone Company Joint Task Force (CITC-JTF), dated 28 April 2008, in relation to the above noted proceeding.

The procedures for Part VII applications are found in the CRTC Telecommunications Rules of Procedures , which are set out on the Commission's website.  Once a Part VII application is filed, interventions from interested parties may be filed within 30 calendar days of the filing date of the application and the applicant may file a reply within 10 calendar days of the receipt of the last answer or intervention.   The Commission may amend this procedure but has not done so in this case.

Bragg Communications Inc., Cogeco Cable Inc., Quebecor Media inc., Rogers Communications Inc. and Shaw Communications Inc. filed their collective application on 4 February 2008 , serving copies on interested parties to Public Notice 2007-16.   In a separate application, Bell Canada and others filed and served a part VII on the same day.

CITC-JTF was an interested party to the proceeding initiated by Public Notice 2007-16.   Furthermore, immediately following receipt of the above noted applications, they became part of publicly accessible files posted on the Commission's website.

Comments in these proceedings were filed by 5 March 2008 .   The records of both proceedings closed on 17 March 2008.

Commission staff notes that CITC-JTF's comments were filed well after the record of these proceedings closed and thus after all interested parties had filed their comments and replies.   Commission staff considers that, in the circumstances, it would be inappropriate to include CITC-JTF's comments as part of the public record.   Therefore, your comments are returned.
