Re: Application for the approval of a summary of the Terms of Service for publication in the introductory pages of the white pages and for an interim stay of the requirement to publish the statement of consumer rights in the white pages directory - Telecom Decision 2006-52

On 6 February 2008, the Commission received the above-mentioned application by Bell Aliant Regional Communications, Limited Partnership, Bell Canada, NorthernTel, Limited Partnership, Northwestel Inc., Saskatchewan Telecommunications, Télébec, Limited Partnership, and TELUS Communications Company (collectively, the Companies). On 6 March 2008, the Commission received a letter from MTS Allstream Inc. supporting the Companies' application.

By letter dated 7 March 2008, the Public Interest Advocacy Centre (PIAC), as counsel for the Consumers' Association of Canada and the National Anti-Poverty Organization, requested that the Commission suspend consideration of the Companies' application in light of the process established in Call for comments on priorities regarding the review of social and other non-economic regulatory measures, Telecom Public Notice CRTC 2008-1, 22 January 2008 (Public Notice 2008-1).

By letter dated 17 March 2008, the Companies indicated that the Commission should proceed with its application, including consideration of the interim relief requested.  

Commission staff notes that the Companies' application raises issues already identified within the action plan set out in Action plan for reviewing social and other non-economic regulatory measures in light of Order in Council P.C. 2006-1534, Telecom Decision CRTC 2008-34, 17 April 2008 (Telecom Decision 2008-34). [1]   Commission staff expects that a proceeding to review the matters raised in the Companies' application will be initiated in the spring of 2008.Given the anticipated overlap in proceedings, Commission staff is returning the Companies' application and closing this file. Parties are invited to resubmit their arguments as part of the upcoming proceeding identified in Telecom Decision 2008-34.
