RE:   Tariff Notice 285:   Accelerated Installation Service - Market Trial

On 25 January 2008, the Commission received an application by TELUS Communications Company (TCC), proposing revisions to General Tariff, Item 408, Accelerated Installation Service - Market Trial in Alberta and British Columbia .   TCC proposed to extend the trial end-date to 30 June 2008 from 15 February 2008 .  

In Review of general tariff bundling rules and requirements for market trials , Telecom Decision CRTC 2007-117, 23 November 2007 (Decision 2007-117), the Commission forbore from the regulation of market trials.   Pursuant to the Decision, the companies are required to provide notice to the Commission at least 10 days prior to the provision of the trialled service to any customer participating in the trial, which includes:

i)        the duration of the trial and the purpose of the trial;

ii)       limitations of scope associated with the trial, including the geographic area(s) of the trial and the nature of, and approximate number of, customers to whom the trialled service will be offered;

iii)       confirmation that prior to participating in the trial, customers will be advised of the fact that the service is being offered on a trial basis for a limited time and that the terms and conditions under which the service is provided could be modified at any time.

In view of the fact that the Commission has forborne from regulating market trials, the file in now closed.

However, Commission staff notes that TCC must now comply with the requirements set out in Decision 2007-117.   In that regard, Commission staff considers that the information provided with the original filing for the market trial combined with the information provided in conjunction with Tariff Notice 285 addresses two of the Commission's three requirements set out in the Decision.   Therefore, TCC is to provide the Commission within 10 days of receipt of this letter confirmation that it will fulfil its obligations under item iii) above.
