Dear Mr. Wilkie:

Re:   Tariff Notice 138 - Withdrawal of Partial Cable - Distribution System

On 28 November 2007, the Commission received an application by TBayTel under cover of Tariff Notice 138 (TN 138) in which TBayTel proposed to withdraw its Partial Cable Distribution System offering (PSO) service.

The Commission received comments from Shaw and reply comments from TBayTel.  

TBayTel is requested to provide its response s to the attached interrogatories by 21 January 2008.   Shaw Communications Inc. (Shaw) may file comments on TBayTel's response to the attached interrogatories by 31 January 2008.   TBayTel may file its reply to Shaw's comments by 7 February 2008.

As there are significant issues related to this application, the Commission expects to issue a decision within 75 business days from the date of the application, as indicated in Telecom Circular 2005-7.

Withdrawal of Partial Cable - Distribution System - Interrogatories

In Telecom Circular CRTC 2005-7 (Circular 2005-7), the Commission indicated that, in assessing an application for destandardization and/or withdrawal, it will examine, among other things, whether the applicant has met the criteria that there is a reasonable substitute for the service being destandardized and/or withdrawn and that there is a clear transition plan.

1)  Provide information on substitutes for TBayTel's PSO service and demonstrate that they are reasonable based on the following factors identified in paragraph 9 of Circular 2005-7:

a)  Functionality of the substitute service
b)  Availability of the substitute service in the same geographical area
c)  Cost of the substitute service (including the initial outlay and ongoing costs)
