  Applications by MTS Allstream Inc. to amend the licence of its Class 1 broadcasting distribution undertaking serving Winnipeg, Manitoba.
  In application no. 2007-0715-1, the licensee requested that the signal of KMSP-TV (FOX) Minneapolis be added to the List of Part 2 eligible satellite services. It also proposed to replace its condition of licence relating to the distribution of U.S. 4+1 signals as part of its basic service, which reads:
 

The licensee may distribute, at its option, as part of the basic service at each community served, the signals of WDAZ-TV (ABC) Grand Forks, North Dakota, KARE-TV (NBC) Minneapolis, Minnesota, WCCO-TV (CBS) Minneapolis, WUHF-TV (FOX) Rochester, New York and KFME-TV (PBS) Fargo, North Dakota.

  with the following condition:
 

The licensee may distribute, at its option, as part of the basic service at each community served, the signals of WDAZ-TV (ABC) Grand Forks, North Dakota, KARE-TV (NBC) Minneapolis, Minnesota, WCCO-TV (CBS) Minneapolis, Minnesota, WUHF-TV (FOX) Rochester, New York and KMFE-TV (PBS) Fargo, North Dakota, or alternatively for each signal, the signal of a different affiliate of the same network located in the same time zone as that of the licensed area and included in the Lists of eligible satellite services, as amended from time to time.

  The licensee stated that it would prefer to distribute the KMSP-TV (FOX) signal originating from Minneapolis, Minnesota, in place of the WUHF-TV (FOX) signal originating from Rochester, New York and submitted that this proposed condition of licence would so permit.
  In application no. 2007-0716-9, the licensee further requested that a new condition be added to its licence, which would read:
 

The licensee is authorized to receive, through fibre facilities, at its option, any of the distant Canadian signals and U.S. 4+1 signals that are otherwise required to be received from a licensed SRDU. This condition does not authorize the licensee to provide these services to any other licensed or exempt distribution undertaking.

  In the licensee's view, this condition of licence would permit it to receive the KMSP-TV (FOX) signal in Minneapolis and transport it to the licensee's head-end in Winnipeg using its own facilities, rather than via a satellite relay distribution undertaking (SRDU).
  The Commission notes that the requirement to receive certain signals from an SRDU is found in the Lists of eligible satellite services. In questions to the licensee dated 29 May 2007, Commission staff noted that the signal of KMSP-TV (FOX) was apparently not available from a licensed SRDU. In its response of 12 June 2007 to those questions, the licensee agreed that, if the Commission replaced the WUHF-TV (FOX) signal in the condition of licence proposed in application no. 2007-0715-1with the KMSP-TV (FOX) signal, it would not be necessary to add the KMSP-TV (FOX) signal to the List of Part 2 eligible satellite services.
  The Commission notes that, if it chooses to amend the licensee's proposed condition of licence related to U.S. 4+1 signals to add an authorization to distribute KMSP-TV (FOX), rather than adding this signal to the List of Part 2 eligible satellite services, concomitant changes would also be necessary to the condition of licence requested in application 2007-0716-9.
