  Further to its Broadcasting Notices of Public Hearing CRTC 2007-3 and 2007-3-1 dated 1 and 13 March 2007 relating to a Public Hearing to be held on 30 April 2007, at 9:30 a.m., at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec, the Commission announces that it will consider the following application.

  Application by Radio Express inc. to renew the licence of the French-language commercial radio programming undertaking CKOD-FM Salaberry-de-Valleyfield, expiring 31 May 2007.
  In CKOD-FM Salaberry-de-Valleyfield - Licence renewal and issuance of mandatory orders, Broadcasting Decision CRTC 2006-353, 10 August 2006, the Commission noted the licensee's failure to comply with many of its obligations and renewed the licence for a period of 9 months. Also, the Commission issued four mandatory orders requiring the licensee to comply with the provisions of sections 2.2.(5), 8(6) and 9(2) of the Radio Regulations, 1986 (the Regulations) and its condition of licence regarding the annual payment of $400 to third parties involved in Canadian talent development.
  It appears to the Commission that the license may have, again, failed to comply with section 9(2) of the Regulations regarding the submission of its annual report for the year ending 31 August 2006.
  The Commission therefore intends to inquire into this matter at the hearing. The Commission also expects the licensee to show cause at the hearing why a new mandatory order should not be issued requiring the licensee to comply with the requirement of section 9(2) of the Regulations concerning the provision of annual reports.
  The Commission will want to discuss with the licensee of all other measures taken or those that could be taken in order to address the concerns raised by this situation, including the imposition of conditions of licence.

  A true copy must be sent to the applicant and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
