  The Commission cancels the public hearing scheduled for 15 January 2008 at 9:30 a.m, at the Conference Centre, Portage IV, 140 Promenade du Portage, Gatineau, Quebec.

On 1 August 2007, the Commission issued letter decisions setting out its determinations with respect to a complaint filed by the Canadian Association of Broadcasters (CAB) that certain broadcasting distribution undertakings (BDUs) had not been performing simultaneous substitution with respect to certain high definition (HD) signals. In its letter decisions, the Commission directed these BDUs, including Shaw Cablesystems and Star Choice, to undertake simultaneous substitution with respect to all HD television stations, and in particular, the CITY-TV station in Toronto and the CTV stations in Toronto and Vancouver, by the end of the calendar year. The Commission further directed Shaw Cablesystems and Star Choice to file detailed plans to implement HD substitution within that time frame.

Shaw Cablesystems and Star Choice failed to provide a detailed plan to implement HD substitution within the time frame specified in the Commission's direction nor did they express an intention to comply with the Commission's instructions to implement HD substitution by the end of the year. Therefore, in Broadcasting Notice of Public Hearing 2007-16, the Commission directed Shaw Communications Inc. (Shaw) to appear at a public hearing to inquire into, hear and determine whether, pursuant to section 12 of the Broadcasting Act, a mandatory order should be issued requiring Shaw Cablesystems and Star Choice to implement HD substitution with respect to digital television stations entitled to it, and in particular those television stations noted by the CAB in a letter to the Commission dated 11 October 2007, i.e., the CTV HD signal in Vancouver, as distributed by the Class 1 cable systems operated by Shaw Cablesystems in the Vancouver area, and the CTV and CITY-TV HD signals in Toronto and the CTV HD signal in Vancouver, as distributed by Star Choice.

On 7 December 2007, the Commission received a letter from Shaw stating that Shaw Cablesystems and Star Choice will implement HD simultaneous substitution under the terms and conditions set out by the Commission by 31 December 2007. By letter dated 11 December 2007, Shaw provided further details as to the progress that Shaw Cablesystems and Star Choice have made towards implementation.

In light of Shaw's expressed intention to comply with the regulatory framework for HD simultaneous substitution, the Commission will not proceed with the hearing announced in Broadcasting Notice of Public Hearing 2007-16.
