Re: Part VII application by Shaw Communications Inc. to revise TBayTel PSO tariff rate

The Commission received a Part VII application, dated 7 September 2005, from Shaw Communications Inc. (Shaw) related to the above noted Partial System Offering (PSO) tariff issue.   Shaw requested that the Commission deal with its application either through a competitive dispute resolution process or through an Order making TBayTel's monthly PSO rate interim.

Commission staff notes that following receipt of the Shaw Part VII application, it attempted to resolve the Part VII issues through mediation between Shaw and TBayTel, but failed.   Commission staff notes that Shaw has advised the Commission that it would not consider any further action on this issue until after local competition had been implemented in TBayTel's territory.   Commission staff notes that local competition has been approved to be implemented in TBayTel's territory with an anticipated start-up date of early December 2007.

Commission staff notes that the record of this proceeding is over two years old.   In order to allow the Commission to make a determination on the issues raised in Shaw's Part VII application, parties are permitted to refresh the record with current information or additional submissions.

Parties are to file their submissions with the Commission by close of business 7 December 2007.   Parties are permitted to file reply comments by close of business 14 December 2007.   Parties are to serve a copy of their submissions and reply comments on each other and the Commission staff members at the email addresses set out below at the same time as they file with the Commission.   Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
