Re: Shaw Communications: application seeking access to Concord Pacific Group's Spectrum Towers Development

On 26 September 2007, Shaw Communications Inc. (Shaw) filed a Part VII application seeking an order in the above noted file.   On 5 October 2007 , Commission staff issued a letter setting out a process of Answer by Concord Pacific Group (Concord) by 26 October 2007 and Reply by Shaw of 5 November 2007.

Commission staff has received correspondence from Concord indicating that it had been unable to secure legal counsel to represent Concord due to Shaw conflicts of interest.   On 29 October 2007, Commission staff was notified by letter that Concord had now retained legal counsel and requested that the due date for its Answer be set back to 12 November 2007.

Commission staff accepts the new filing date and adjusts the process in the above file.   Accordingly, Concord is to file its Answer by 12 November 2007 and Shaw is to Reply by 19 November 2007.

Parties are requested to file a copy of their submissions with the Commission and each other and the other listed persons at the electronic addresses set out below.   Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.

Yours sincerely
