Re: MTS Allstream v. City of Vancouver - Part VII Application for Municipal Access

On 9 August 2007, the process for the above noted Part VII application proceeding was placed on hold by Commission staff due to the ongoing strike by City of Vancouver inside and outside workers. In that letter it was noted that once the strike was over, Commission staff would establish the balance of the process for this proceeding.

On 15 October 2007 , the City of Vancouver advised Commission staff that new agreements had been ratified on 10 October 2007 and 15 October 2007 and that the strike was now over.

With the conclusion of the strike, the balance of the proceeding process may now be established. Commission staff notes that MTS Allstream had requested an interrogatory process, and that the City of Vancouver was not opposed to such a request. Therefore, the revised process will include an interrogatory process, and the dates for the balance of the proceeding are:

MTS Allstream and the City of Vancouver may address interrogatories to each other, and any such interrogatories must be filed with the Commission and served on the relevant party, by 13 November 2007. The Commission may also address interrogatories to either MTS Allstream or the City of Vancouver by the same date.

Responses to interrogatories are to be filed with the Commission and served on the other party, by 11 December 2007.

Requests by either party for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information, for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served to the relevant party, by 17 December 2007.

Written responses to requests for further response to interrogatories and requests for public disclosure must be filed with the Commission and served on the party, by 8 January 2008.

Determinations will be issued with respect to requests for further information and public disclosure as soon as possible.   Any information to be provided pursuant to that determination will be filed with the Commission and served on the other party, by 31 January 2008.

MTS Allstream may file written comments with the Commission on any matter within the scope of the Part VII application, serving a copy on the City of Vancouver , by 13 February 2008.

The City of Vancouver may file an additional written answer with the Commission, serving a copy on MTS Allstream, by 22 February 2008.

MTS Allstream may file written reply comments with the Commission, serving a copy on the City of Vancouver , by 29 February 2008.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date. Submissions may be filed either electronically or on paper. Submissions longer than five pages should include a summary. Electronic submissions should be in HTML format, or alternatively, submissions may use "Microsoft Word" for text and "Microsoft Excel" for spreadsheets.

Each paragraph of all submissions should be numbered. In addition, the line***End of Document*** should be entered following the last paragraph. This will help the Commission verify that the document has not been damaged during electronic transmission.
