Re: Barrett Xplore Inc. - Application to Review & Vary Telecom Decision CRTC 2007-50

On 13 August 2007 , Barrett Xplore Inc. (BXI) filed an application pursuant to section 62 of the Telecommunications Act and Part VII of the CRTC Telecommunications Rules of Procedure , requesting that the Commission review and vary certain aspects of Telecom Public Notice CRTC 2006-15 - Use of deferral account funds to expand broadband services to certain rural and remote communities , Telecom Decision CRTC 2007-50, 6 July 2007 (Decision 2007-50) [1] .   BXI also requested a stay of implementation of those same aspects of Decision 2007-50 pending completion of the Commission's review and pending the Commission's upcoming decision at the end of the proceeding initiated by Review of proposals to dispose of the funds accumulated in the deferral accounts , Telecom Public Notice CRTC 2006-15, 30 November 2006 .

Comments related to BXI's application were received from Bell Aliant Regional Communications, Limited Partnership and Bell Canada ( Bell Aliant/ Bell Canada ), the Canadian Cable Systems (CCSA), TELUS Communications Company (TCC), Open Source Solutions (OSS), and Xittel Telecommunications Inc. (Xittel).

Commission staff notes that in Service standards for the disposition of telecommunications applications , Telecom Circular CRTC 2006-11, 7 December 2006, the Commission stated that it would categorize Part VII applications into two types: Type 1 applications that generally do not involve multiple parties or raise significant policy issues, and Type 2 applications that do involve multiple parties and/or raise significant policy issues.

Commission staff also notes that the Commission has adopted the following service standards for Part VII applications:

•  Type 1 Part VII applications - 90 percent of determinations to be issued on an interim or final basis within four months of the close-of-record; and

•  Type 2 Part VII applications - 85 percent of determinations to be issued on an interim or final basis within eight months of the close-of-record.

 Commission staff has assessed BXI's application and considers it to be a Type 2 application. Accordingly, the Commission expects to issue an interim or final determination within 8 months of the close-of-record.
