Re:   Mitchell Seaforth Cable T.V. Ltd. - Application to Review & Vary Telecom Decision CRTC 2007-50

On 17 July 2007 , Mitchell Seaforth Cable T.V. Ltd. (Mitchell Seaforth) filed an application under Part VII of the CRTC Telecommunications Rules of Procedure .   Mitchell Seaforth requested that the Commission review and vary Telecom Public Notice CRTC 2006-15 - Use of deferral account funds to expand broadband services to certain rural and remote communities , Telecom Decision CRTC 2007-50, 6 July 2007 [1] , to exclude Dublin , Ontario from the list of uncontested communities.   Bell Canada filed comments with the Commission on 17 August 2007 .

Commission staff notes that in Service standards for the disposition of telecommunications applications , Telecom Circular CRTC 2006-11, 7 December 2006, the Commission stated that it would categorize Part VII applications into two types: Type 1 applications that generally do not involve multiple parties or raise significant policy issues, and Type 2 applications that do involve multiple parties and/or raise significant policy issues.

Commission staff also notes that the Commission has adopted the following service standards for Part VII applications:

  • Type 1 Part VII applications - 90 percent of determinations to be issued on an interim or final basis within four months of the close-of-record; and

  • Type 2 Part VII applications - 85 percent of determinations to be issued on an interim or final basis within eight months of the close-of-record.

Commission staff has assessed Mitchell Seaforth's application and considers it to be a Type 2 application. Accordingly, the Commission expects to issue an interim or final determination within 8 months of the close-of-record.
