Re: Review of regulatory framework for wholesale services and definition of essential service - Telecom Public Notice CRTC 2006-14 

Pursuant to the procedures set out at paragraph 45 in Review of regulatory framework for wholesale services and definition of essential service, Telecom Public Notice CRTC 2006-14-3, 16 March 2007 (Public Notice 2006-14-3), responses to interrogatories are to be filed with the Commission and served on all parties by 2 August 2007.

On 27 July 2007 , the Commission received a request from Shaw Communications Inc. (Shaw) seeking an extension to the 2 August 2007 date.   In its request, Shaw stated that it would be unable to complete its responses to the interrogatories within the time made available under the procedures set out in Public Notice CRTC 2006-14-3, due to the amount of time and resources required to respond to the interrogatories.   Shaw requested a 7 day extension for the filing of interrogatory responses until 9 August 2007 .

The Commission received a letter in support of Shaw's request from Cogeco Cable Inc. (Cogeco) dated 30 July 2007 .

On review of the request by Shaw and the subsequent letter of support from Cogeco, Commission staff considers the request for an extension to the 2 August 2007 interrogatory response date to be reasonable

Consequently, the procedural dates set out in paragraphs 45, 46, 47 and 48 respectively of Public Notice 2006-14-3 are revised as follows:

45.    Responses to interrogatories addressed pursuant to paragraph 44 are to be filed with the Commission and served on all parties by 9 August 2007 .

46.    Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 16 August 2007 .

47.    Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 22 August 2007 .

48.    A determination will be issued with respect to requests for further information and public disclosure as soon as possible. Any information to be provided pursuant to that determination will be filed with the Commission and served on all interested parties by 10 September 2007 .
