Re: Part VII application by MTS Allstream v. City of Vancouver

In a letter dated 31 May 2007 to the Commission, the City of Vancouver requested direction on whether MTS Allstream Inc's submission of 15 May 2007 should be considered a new Part VII application or a continuation of the Part VII application originally submitted on 24 January 2005 .

When the Commission issued its letter of 1 September 2005 in regards to MTS Allstream's 24 January 2005 Part VII application, it provided guidelines as to what it considered to be reasonable for some of the terms and conditions associated with a municipal access agreement. The Commission also provided some further suggestions that could be used by MTS Allstream and the City of Vancouver in their negotiations of other terms and conditions. The Commission further advised that if there was no agreement within 60 days of the date of the letter, either party could notify the Commission of the status of the negotiations and the Commission would provide for a short process of answer and reply, and then issue a decision on an expedited basis.  

Even though some time has passed since the Commission's letter and the timeframes set out therein, Commission staff considers that MTS Allstream's filing of 15 May 2007 is further to the process set out in the 1 September 2005 Commission letter and is notification that the negotiations between MTS Allstream and the City of Vancouver have been unsuccessful in finalizing a municipal access agreement. Therefore, further to the direction set out in the Commission's letter a short process of answer and reply is now required.

Therefore, the City of Vancouver is requested to submit to the Commission its response to the 15 May 2007 MTS Allstream submission by 24 July 2007 , and MTS Allstream is requested to submit to the Commission its reply by 3 August 2007 .
