Re:   Local Forbearance: Demonstration that competitor quality of service requirements met for the Fort McMurray exchange 

This is a follow-up to the letter dated 1 June 2007 in which Commission staff suspended the comment period related to an earlier filing by TELUS Communications Company (TCC) of competitor quality of service (Q of S) data, pending the outcome of two proceedings [1] that were still before the Commission.

In a letter dated 8 June 2007 , TCC provided a more recent six-month period [2] of competitor Q of S data that does not rely on determinations by the Commission in the two aforementioned proceedings.   TCC submitted that the more recent data demonstrated that it met the competitor Q of S criterion set out in paragraph 242 of Forbearance from the regulation of retail local exchange services , Telecom Decision CRTC 2006-15, 6 April 2006 as modified by Order Varying Telecom Decision CRTC 2006-15 , P.C. 2007-532, 4 April 2007 (Decision 2006-15) .

TCC requested therefore, that the Commission should issue an order declaring that TCC is forborne from regulation of residential local exchange services in Fort McMurray .

In light of the more recent competitor Q of S data provided by TCC, Commission staff considers that the suspension of the comment period with regard to Fort McMurray is no longer necessary.

Accordingly, as per Timelines for submissions regarding local forbearance applications , Telecom Circular CRTC 2007-13, 19 April 2007 , parties have until 18 June 2007 to provide comments to the Commission, serving a copy on TCC, on the competitor Q of S data provided by TCC.

TCC would then have until 25 June 2007 to provide reply comments, serving copies on the parties providing comments.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
