ATTACHMENT

Shaw filed as Appendix 1 to its application a Municipal Access Agreement template (the Appendix 1 MAA).

Maple Ridge also filed as Appendix 3 to its answer of 30 April 2007 , a copy of the Municipal Access Agreement entered into by the City of Richmond and Shaw (the Richmond MAA).

In view of Ledcor/Vancouver - construction, operation and maintenance of transmission lines in Vancouver , Telecom Decision CRTC 2001-23, 25 January 2001 , compare with reference to specific clauses, the terms and conditions set out in Appendix 1 MAA with the correlative terms and conditions of the Richmond MAA.

In the comparison, indicate, with supporting rationale, which clauses of the Appendix 1 MAA and the Richmond MAA would be acceptable and which clauses would not be acceptable, as part of the terms and conditions for an MAA between Shaw and Maple Ridge.   Where relevant, provide alternate wording that would address your concern.
