Re:   Application by the Canadian Association of the Deaf associated with the implementation of the teletypewriter program in Access to pay telephone service, Telecom Decision CRTC 2004-47

The Commission received an application dated 22 February 2007 from the Canadian Association of the Deaf (CAD).   The CAD requested that the Commission instruct all incumbent local exchange carriers (ILECs) to file an application if they wished to implement a new and/or different technology to meet the pay telephone teletypewriter upgrade program (TTY program) requirements set out in Access to pay telephone service , Telecom Decision CRTC 2004-47, 15 July 2004 (Decision 2004-47).   In support of its application, the CAD submitted that by letter to Bell Canada dated 28 July 2006, Commission staff had instructed Bell Canada that if it wished to install "keypad TTYs" as part of its compliance with Decision 2004-47, Bell Canada had to file an application to do so.  

The CAD further submitted that certain ILECs, including MTS Allstream Inc. and TELUS Communications Company (TCC), had not followed the Commission staff's instruction and had gone ahead and begun to install keypad TTYs in their serving area.   The CAD also requested that the Commission require these ILECs to cease and desist from installing keypad TTYs as a means of complying with the TTY program established in Decision 2004-47.  

The Commission received comments on CAD's application from TCC on 20 March 2007 and reply comments from the CAD on 27 April 2007 .   The CAD also filed additional information with the Commission along with its 27 April 2007 reply comments.

This letter shall serve to advise that CAD's application will be processed under Part VII of the CRTC Telecommunications Rules of Procedure .   All submissions regarding this Part VII application, received prior to the issuance of this letter, will be added to the record of this proceeding and will be available on the Commission's website.

In order to ensure a full and complete record in relation to this matter, parties may file comments with the Commission on the issues raised in both CAD's application and its reply comments, by 11 June 2007 , serving a copy on all other parties.   The CAD may file further reply comments with the Commission by 21 June 2007 , serving a copy on all parties.  

Commission staff reminds parties that, where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
