RE:   Tariff Notice No. 236 - Migration of several services to the Aliant Telecom General Tariff

The Commission received an application by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant) under cover of Tariff Notice 236, dated 2 May 2007 , in which the company proposed to transfer several Bell Aliant predecessor company tariffs to the Aliant Telecom Inc. General Tariff.

In its application, among other things, Bell Aliant proposed to grandfather the following tariff items:

•  item 49, The Second Line Package, available in New Brunswick ,

•  item 400,   Residence Service Package, available in Newfoundland and Labrador , and

•  item 410, Business Service Package, available in Newfoundland and Labrador

The company proposed that the current customers of the services being grandfathered will be permitted to continue to subscribe to, and move the service from one address to another.   In addition, the company proposed that the bundles would not be available for new subscriptions and could not be added to an account once removed.

In New procedures for disposition of applications dealing with the destandardization and/or withdrawal of tariffed services, Telecom Circular CRTC 2005-7, 30 May 2005 (Circular 2005-7), the Commission set out the information requirements for it to properly assess a proposal for destandardization and/or withdrawal of a service.

Commission staff notes that the above-noted proposals in the company's application do not conform to the evidentiary requirements set out in Circular 2005-7.   Accordingly, the file is now closed.

The Commission is willing to consider a new application from Bell Aliant under the cover of a new tariff notice where the company's proposals for the destandardization and/or withdrawal of a service will include the required information set out in Circular 2005-7.
