Re: Review of regulatory framework for wholesale services and definition of essential service
On 22 December 2006, the Commission received a request by Bell Canada that the Commission amend the list of entities that are made parties to the proceeding initiated by Review of regulatory framework for wholesale services and definition of essential service , Telecom Public Notice CRTC 2006-14, 9 November 2006, as amended by Telecom Public Notice CRTC 2006-14-1, 15 December 2006 (Public Notice 2006-14). In particular, Bell Canada requested that the Commission add as parties certain Municipal Electrical Utility Companies (MEUs) that offer and/or provide services within the scope of the Public Notice 2006-14 proceeding.
On 4 January 2007 , the Commission received comments from TELUS Communications Company (TCC), in which TCC stated that it supports Bell Canada 's request that the MEUs named in the Bell Canada letter be added as parties to the PN 2006-14 proceeding. TCC noted two MEUs based in western Canada , namely Enmax Corporation and Epcor.
TCC also noted that the availability of wholesale facilities from carriers other than an incumbent local exchange carrier has a direct bearing on whether such facilities are essential.
On 12 January 2007 , the Commission received comments from MTS Allstream Inc. (MTS Allstream), in which MTS Allstream stated that it opposed Bell Canada 's and TCC's requests.
Any person or party may file submissions with the Commission, serving copies on Bell Canada and TCC, by 23 January 2007, with regard to MEUs and Canadian carriers being declared, by the Commission, as parties to the Public Notice 2006-14 proceeding as per Bell Canada's and TCC's respective requests. Parties' submissions should include the name of any Canadian carrier or MEU that they consider should be added as a party, with supporting rationale, as applicable.
Bell Canada and TCC may file comments in reply with the Commission by 26 January 2007 , serving a copy on those who filed comments.
Commission staff expects that if the Commission makes a determination to add parties to the proceeding, the Public Notice 2006-14 procedure dates would be adjusted as appropriate. Parties may, in their comments, address such adjustments to the Public Notice 2006-14 procedure dates, as well as the inclusion of provisions within Public Notice 2006-14 requiring the persons made party to the proceeding to identify wholesale services that they provide, and allowing parties to address interrogatories to any person that the Commission has made party to the proceeding.
Parties are reminded that all submissions must be received, not merely sent, by the dates indicated. Parties are also requested to send a separate copy of their submissions to Bob Martin at robert.martin@crtc.gc.ca
