The Commission renews the broadcasting licence for the ethnic commercial radio programming undertaking CFMB Montréal, from 1 September 2007 to 31 August 2014.

The application
|

CFMB Limited (CFMB) filed an application to renew the broadcasting licence for the ethnic radio programming undertaking CFMB Montréal.
|

As part of its application, CFMB applied for an exception to the requirement to allocate funds to the Foundation Assisting Canadian Talent on Recordings (FACTOR) or MUSICACTION set out in Broadcasting Public Notice 2006-158. Instead, the applicant proposed to redirect its required basic annual Canadian content development (CCD) contribution to eligible initiatives reflecting the ethnic character of its station. CFMB specified that its basic annual CCD contribution would be divided between FACTOR, MUSICACTION and annual bursaries for students of music and journalism.The applicant added that if at a later date the Commission were to recognize contributions to support the Canadian Association of Ethnic Broadcasters' ethnic music catalogue, it would allocate a portion of its basic annual contributions to the catalogue.

Commission's analysis and conclusions

The Commission notes that it received an intervention in connection with the application from the Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ) expressing disappointment over the applicant's decision not to allocate 60% of its basic annual CCD contribution to FACTOR or MUSICACTION. ADISQ asked that the Commission impose a condition of licence requiring the licensee to devote 60% of its basic annual CCD contribution to MUSICACTION.

The Commission reminds the intervener that in Broadcasting Public Notice 2006-158 the Commission stated that because ethnic licensees operate stations that make relatively limited use of Canadian music, they will not be required to contribute to FACTOR or MUSICACTION. Rather, they will be free to direct their payments to eligible initiatives that support their content.

The Commission notes that the applicant has indicated its willingness to abide by a condition of licence to that effect. Accordingly, the Commission renews the broadcasting licence for the ethnic radio programming undertaking CFMB Montréal, from 1 September 2007 to 31 August 2014. The licence will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of condition of licence number 5, as well as to the conditions set out in the appendix to this decision.

Conditions of licence and encouragement

Conditions of licence
|

1. The licensee shall provide programming directed to a minimum of 19 cultural groups in a minimum of 18 different languages.
|

2. The licensee shall make a basic annual contribution to Canadian content development (CCD). The amount of the contribution shall be determined in accordance with the policy set out in Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006 (Public Notice 2006-158), as amended from time to time.

The licensee shall allocate 60% of this basic annual CCD contribution to FACTOR, MUSICACTION or other eligible initiatives that support the creation of ethnic programs.
|
|
The remainder of this basic annual contribution to CCD shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives in Public Notice 2006-158.
|
|
This condition of licence shall expire upon the coming into force of the amendments to the Radio Regulations, 1986 relating to CCD.

Encouragement
|
|
In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
