  Application by Cogeco Cable Quebec Inc. (Cogeco)to amend the licences of its cable distribution undertakings serving the above-mentioned locations.
  The licensee specifies that this amendment applies to both its current class 1, 2 and 3 licences as well as its proposed regional licences applied for in applications 2005-1579-4, 2005-1580-2 and 2005-1581-9, if approved by the Commission.
  Cogeco proposes a "zone-based" approach for its community programming. The proposal can be summarized as follows:
 

(1) For the purpose of community programming, the authorized service areas would be divided into twelve zones. Each zone would include a Class 1 or 2 service area with its own headend and studio facilities interconnected with 1-12 service areas (i.e. Class 2 and/or 3 service areas).

 

(2) In each of these 12 zones, Cogeco would commit to (i) broadcast a minimum of 60% of local programming on the community channel that is reflective of the community and that would be produced either by Cogeco, by members of the community being served or by a community television corporation residing in the zone; and (ii) broadcast a minimum of 30% of community access television programming produced by individuals, by groups or by a community television corporation residing in the zone.

  In order to implement this approach, Cogeco proposes new conditions of licence establishing twelve zones that would each be considered service areas for the purposes of sections 27, 27.1, 28, 29 and 35 of the Regulations and other conditions of licence pertaining to subsections 27.1(1) and 27.1(3).   The licensee has provided an update on its distribution to date of the benefit expenditures set out in Broadcasting Decision CRTC 2001-768, 20 December 2001, involving its acquisition of CHOM-FM. The licensee has also provided its plans related to the disbursement of the remaining benefits and its plans related to Canadian talent development commencing 1 September 2006.

  Application by 3095531 Nova Scotia Company to amend the licences of television programming undertaking CKXT-TV Toronto and that of the transitional digital television programming undertaking CKXT-DT Toronto.
  The licensee proposes to amend the condition of licence 4a) that was amended in part in Broadcasting Decision CRTC 2005-476, 3 October 2005, relating to the New Voices Fund, which reads:
 

4a) From 2 December 2004 to 31 August 2008, the licensee shall expend at least $4,000,000 in licence fees for independently-produced ethnic programs in English, and at least $500,000 for script and concept development for such programs. Administrative costs shall not be included in these amounts. The programming funded by the amounts set out in this condition shall not include any programming covered by conditions of licence 3 and 4b). For purposes of this condition, "expend" means actual cash outlay.

  with the following condition:
 

4a) From 2 December 2004 to 31 August 2011, the licensee shall expend at least $3,598,000 in licence fees for independently-produced ethnic programs in English, and at least $500,000 before 31 August 2008 for script and concept development for such programs. Administrative costs shall not be included in these amounts. The programming funded by the amounts set out in this condition shall not include any programming covered by condition of licence 4b). For purposes of this condition, "expend" means actual cash outlay.

  The licensee further proposes to amend the condition of licence 4b) of Broadcasting Decision CRTC 2002-81 of 8 April 2002 which reads:
 

4b) Over the licence term, the licensee shall expend at least $6,650,000 on licence fees for priority programs, and at least $675,000 for script and concept development for such programs. Administrative costs shall not be included in these amounts. The programming funded by the amounts set out in this condition shall not include expenditures on any programming covered by conditions of licence 3 and 4a). For purposes of this condition, "expend" means actual cash outlay.

  This was amended in Broadcasting Decision CRTC 2004-503, 19 November 2004 when the Commission accepted the TVA and Sun Media proposal to add $3 million for the Priority Program Fund as a tangible benefit of the transfer of effective control of Toronto One to TVA Group Inc. and Sun Media Corporation.
  with the following condition:
 

4b) Over the licence term, the licensee shall expend at least $9,737,000 on licence fees for priority programs. Administrative costs shall not be included in these amounts. The programming funded by the amounts set out in this condition shall not include expenditures on any programming covered by conditions of licence 3 and 4a). For purposes of this condition, "expend" means actual cash outlay.

  The licensee stated that the licence amendments would allow SUN TV to funnel approximately $4,339,000 ($3,751,200 from the New Voices Fund plus $587,800 from the Priority Fund) for the new Public Affairs program, "Canoe Live".
  The licensee requested that the amendments include CKXT-DT Toronto. The Commission in Broadcasting Decision CRTC 2005-476 amended condition 1 of the licence for CKXT-DT which read as follows:
 

In addition to the conditions set out below, the licence is subject to the terms and conditions applicable to the analog television station CKXT-TV Toronto, as set out in New television station for Toronto/Hamilton, Broadcasting Decision CRTC 2002-81, 8 April 2002, or as later amended.

  Consequently, it is not necessary for the Commission to further amend the licence for CKXT-DT.
