  The licensee proposes to replace the condition of licence relating to the measurement of Canadian content which reads:
 

2. The licensee shall devote no less than 90% of the broadcast week to the distribution of Canadian programs.

For the purpose of this condition, ''broadcast week'' means seven consecutive broadcast days, beginning on Sunday.

  Application by Cogeco Cable Canada Inc. to amend the licence of its regional video on demand programming undertaking (VOD).
  The licensee proposes to add a condition of licence that would prohibit it from distributing programming that contains any commercial message except if the message is already included in a program previously aired by a Canadian television programming undertaking and is subsequently offered on an on-demand basis at no charge to the subscriber.
  To this end, the licensee proposes that the condition of licence pertaining to adherence to the Pay Television Regulations, 1990 be amended as follows:
 

The licensee shall adhere to the Pay Television Regulations, 1990, with the exception of section 3(2)(d) (commercial messages) and section 4 (logs and records)

  The licensee also proposes to add the following condition of licence:
 

The licensee shall not include as part of its VOD offering any program including a commercial message except where:

 

a. the message was already included in a program previously broadcast by a Canadian programming service;

 

b. the program's inclusion as part of the VOD offering is in accordance with the terms of a written agreement entered into with the operator of the Canadian programming service that broadcast the program; and

 

c. the program is offered to subscribers on an on-demand basis at no charge.

  Application by Canadian Broadcasting Corporation (CBC) to amend the licence of radio programming undertaking CBN-FM St. John's.
  The licensee proposes to add an FM transmitter atBaie Verteto broadcast the programming of CBN-FM St. John's in order to provide the population of Baie Verte and its surrounding area with the Radio Two service.
  The transmitter would operate on frequency 95.5 MHz (channel 238C1) with an effective radiated power of 49,000 watts (non-directional antenna/antenna height of 253.9 metres).
  The licensee states that this application is a step towards the fulfillment of CBC's commitment to extend the coverage of Radio Two to as many Canadians as possible, within its financial means.

  Application by Tillsonburg Broadcasting Company Limited (TBCL) for the use of frequency 107.3 MHz (channel 297B) with an average effective radiated power of 4,500 watts (maximum effective radiated power of 15,000 watts/antenna height of 163.5 metres) for the operation of the English-language commercial FM radio programming undertaking approved in CKOT Tillsonburg - Conversion to FM band, Broadcasting Decision CRTC 2005-432 (Decision 2005-432), dated 25 August 2005.
  The licensee also proposes to continue the operation of its AM transmitter, during the daytime only, on frequency 1510 kHz with a transmitter power of 10,000 watts in order to simulcast the programming of the new FM station.
  As a result, the programming of the new FM station would be available on both the AM and FM bands during the day, and only on the FM band at night.
  The present application is filed in response to Decision 2005-432, in which the Commission stated that it would only issue a licence to TCBL if it submitted an application proposing the use of another FM frequency and technical parameters that are acceptable to both the Commission and the Department of Industry.

  Application by CHRY Community Radio Incorporated relating to the licence of the community-based campus radio programming undertaking CHRY-FM Toronto.
  The licensee proposes to change the authorized contours by increasing the effective radiated power from 50 watts to an average effective radiated power of 158 watts and by increasing the antenna height (maximum effective radiated power of 250 watts/antenna height of 63.5 metres).
  The increase in power would result in a change of CHRY-FM's status from a low power unprotected service to a regular Class A1 service.
  The licensee stated that it wished to gain protected status. It stated also that the proposed changes will result in a better quality signal to listeners and ensure greater community involvement.
