On 1 February 2006, BCE Inc. (BCE) announced its intention to form a new regional income trust (Bell Communications) that would offer wireline, legacy data, and Internet services over approximately 1.6 million local access lines in certain parts of Bell Canada's territory in Ontario and Quebec. BCE also indicated that there would be no changes to the services offered to Bell Canada's customers or to the terms and rates applicable to those services, as a result of this corporate restructuring.

The Commission received four applications by Bell Canada, filed between 15 June and 27 June 2006, under cover of Bell Communications Tariff Notices (TNs) 8, 9, 10, and 12, proposing revisions to Bell Communications' General Tariff and Special Facilities Tariff.

The Commission also received an application by Bell Canada, dated 19 June 2006, under cover of TN 6961, proposing revisions to its General Tariff. Bell Canada noted that the proposed revisions corresponded to similar provisions in the equivalent tariffs proposed for Bell Communications in TN 8.

The Commission approved, on an interim basis, Bell Canada's applications, in respect of Bell Communications TNs 8, 9, 10, 12, and Bell Canada TN 6961 in Telecom Order CRTC 2006-172, 6 July 2006 (Order 2006-172). The Commission noted in Order 2006-172 that its approval was subject to Bell Canada confirming in writing to the Commission that the formation of the proposed income trust had been completed.

By letter dated 10 July 2006, Bell Canada confirmed to the Commission that the formal name of the proposed income trust would be Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), and that the formation of Bell Aliant was completed on 7 July 2006.

Subsequently, in Revisions to Bell Aliant's and Bell Canada's tariffs, Telecom Order CRTC 2006-205, 9 August 2006 (Order 2006-205), the Commission approved on a final basis, among other things, the Bell Aliant tariffs. In Order 2006-205, the Commission inadvertently granted final approval to certain Bell Aliant tariffs when the corresponding Bell Canada tariffs had only been granted interim approval because of ongoing proceedings. These Bell Canada tariffs, refiled as Bell Aliant tariffs, should not have been approved on a final basis. As a result, paragraph 7 of Order 2006-205 should read as follows:

7. Given that the Commission was informed of the formation of Bell Aliant pursuant to Order 2006-172 and that the comment period has elapsed, the Commission approves on a final basis Bell Canada's applications with the exception of TN 10 and the items listed below, for which approval will remain interim because of ongoing proceedings.
