Broadcasting Notice of Public Hearing CRTC 2006-9-3

  Further to its Broadcasting Notices of Public Hearing CRTC 2006-9 dated 31 August 2006 and 2006-9-1 and 2006-9-2 dated 11 and 20 September 2006 relating to a Public Hearing which will be held on 30 October 2006 at 9:30 a.m., at the Delta Regina, 1919 Saskatchewan Drive, Regina, Saskatchewan, the Commission announces the following:
  The Commission will accept interventions that only relate to the information provided in this notice and any other additional information WHICH may be placed on the public examination file of the following applications by 19 OCTOBER 2006. The Commission therefore invites interested parties to review the public examination file of those applications.

The deadline for submission of interventions is EXTENDED TO 24 October 2006.

  The Commission has requested additional information from Aboriginal Voices Radio Inc. (AVR) concerning the expenditures of funds over the licence period of its currently licensed undertakings and the availability of funds for the future. The Commission notes that the additional information is to be submitted no later than 19 October 2006.
  Furthermore, with regards to item 25, the Commission notes that the licensee appears to have failed to comply with the Radio Regulations, 1986 concerning the filing of annual returns in the case of its undertaking CKAV-FM Toronto, for the years 2001-2002, 2002-2003 and 2003-2004.

  In respect of the applications by Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership and Saskatoon Radio Broadcasting Ltd., Nav Canada has indicated the possibility of strong interference to NAV/COM facilities due to the use of the frequency (106.7 MHz) in conjunction with two others that have been proposed in the Saskatoon area (106.1 MHz by Radio CJVR Ltd. and 102.9 MHz by AVR). Therefore, Nav Canada does not recommend the use of frequency 106.7 MHz. However, it could probably be used if only one of the two frequencies stated above (106.1 Hz or 102.9 MHz) was to be approved for operation.
  In respect of the application by Aboriginal Voices Radio Inc., Nav Canada has indicated the possibility of strong interference to NAV/COM facilities due to the use of this frequency (102.9 MHz) in conjunction with two others that have been proposed in the Saskatoon area (106.1 MHz, by Radio CJVR Ltd. and 106.7 MHz, by Jim Pattison Broadcast Group Limited Partnership and Saskatoon Radio Broadcasting Ltd.).   The Commission has requested additional information from Saskatoon Radio Broadcasting Ltd. (SRB) concerning the operation of the proposed Saskatoon Radio Broadcasting Trust and its compliance with the Direction to the CRTC (Ineligibility of non-Canadians). The Commission has asked that the applicant file this information no later than 19 October 2006.

  A true copy must be sent to the applicant and proof that this has been done must accompany the intervention sent to the Commission.
  The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
  Before initiating service through electronic mode, please ensure that you will be able to satisfy the Commission, upon request, that service of the notification was completed.
  Where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
  Each paragraph of the document should be numbered.
  Your intervention should clearly identify the application and indicate whether you support or oppose the application, or if you propose changes to it, include the facts and grounds for your proposal.
  In the event that the application is brought to the oral phase of the hearing, and if you wish to appear, you must provide reasons why your written comments are not sufficient and why an appearance is necessary.
  Persons requiring communications support such as assistance listening devices and sign language interpretation are requested to inform the commission at least twenty (20) days before the commencement of the public hearing so that the necessary arrangements can be made.
