Re: Telecom Public Notice CRTC 2006-10 - Continued need for the regulatory constraints applicable to toll and toll-free services

Pursuant to paragraph 24 of Continued need to the regulatory constraints applicable to toll and toll-free services , Telecom Public Notice CRTC 2006-10, 7 July 2006 , interrogatories were issued to parties on 1 September 2006 .   The Commission received responses to these interrogatories between 22 September 2006 and 28 November 2006 .

In its letter dated 23 November 2006 that disposed of requests for disclosure of confidential information and for further responses, Commission staff indicated that supplemental interrogatories would be issued and that the dates set out at paragraphs 29 and 30 of PN 2006-10 would be revised.

Bell Aliant Regional Communications, Limited Partnership, Bell Canada, MTS Allstream Inc., Ontera , Saskatchewan Telecommunications, and TELUS Communications Company are requested to provide responses to the supplemental interrogatories set out in Attachment 1.

Responses to interrogatories are to be filed with the Commission and copies served on all other parties by 12 January 2007 .

Requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 19 January 2007 .

Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 26 January 2007 .

A determination will be issued with respect to requests for further information and public disclosure as soon as possible.   Any information to be provided pursuant to that determination must be filed with the Commission and served on all parties by 9 February 2007 .

The procedure set out at paragraphs 29 and 30 of PN 2006-10 is revised as follows:

29.   All parties may file written arguments with the Commission on any matter within the scope of this proceeding, serving copies on all other parties, by 16 February 2007 .

30.   All parties may file reply arguments with the Commission, serving a copy on all other parties, by 23 February 2007

Where a document is to be filed or served by a specific date, the document must actually be received, not merely sent by that date.

ATTACHMENT

The following interrogatories are addressed to Bell Aliant Regional Communications, Limited Partnership, Bell Canada, MTS Allstream Inc., Ontera , Saskatchewan Telecommunications, and TELUS Communications Company.

1.  The following question is intended to ensure that consistent information was provided by the companies in response to (CRTC)1Sept06-01.   For each of the years from 2001 to 2005, provide the following information.   Basic toll customers are those customers that are PIC'd to the company and do not subscribe to one of the company's discount toll plans.   Information for basic toll customers should be included whether or not a basic toll customer has made a toll call within a particular period.

a)   Provide the percentage of residential basic toll subscribers to the residential customers that are PIC'd to the company.

b)   Provide the percentage of business basic toll subscribers to the business customers that are PIC'd to the company.

c)   Provide the percentage of basic toll minutes for residential customers to the total toll minutes for residential customers.

d)  Provide the percentage of basic toll minutes for business customers to the total toll minutes for business customers.

e)   Provide the percentage of residential basic toll revenues to the total toll revenues for residential customers.

f)   Provide the percentage of business basic toll revenues to the total toll revenues for business customers.

2.  If the Commission were to determine that it would be appropriate to retain some price protection for basic toll subscribers:

a)  Provide the company's views on a simplified basic toll schedule under which basic toll customers would be charged a flat rate per minute that is approved by the Commission for toll calls.   The 50% discount for those calls that are currently subject to the 50% discount would continue to apply.

b)   If a simplified schedule as described in (a) was to be implemented, indicate the company's view on whether there should be only one flat rate per minute for all basic toll calls or more than one flat rate depending on the destination (e.g., for calls to a destination within Canada or for calls to a destination within the United States).   Indicate, with supporting rationale, the appropriate rate(s).

c)   Provide the company's views on a simplified basic toll schedule under which basic toll customers would be charged a flat rate per minute for toll calls, as long as the rate was at or below a capped rate per minute that is approved by the Commission.   The 50% discount for those calls that are currently subject to the 50% discount would continue to apply.

d)   If the option in (c) was to be implemented, indicate the company's views on whether there should be only one capped rate for all basic toll calls or more than one capped rate depending upon the destination (e.g., for calls to a destination within Canada or calls for a destination within the United States).   Indicate, with supporting rationale, the appropriate capped rate(s).

e)   Indicate the company's preference as to (a), (b), (c) or (d) above.
